Blogs Terms of Use

Entering Blogs will constitute acceptance of the terms of use (the “Blog Rules”). If you don't agree to abide by these terms of use, please don't enter our Blog.

The Blog Service (“Blogs”) owned and operated by Orange Home UK Limited, St James Court, Great Park Road, Almondsbury Park, Bradley Stoke, Bristol, BS32 4QJ (“Orange”) gives the Orange community a place to meet, discuss and share ideas. As in a real community, users of Blogs are asked to respect others.

The Blog Rules, which are listed here, are intended to protect Blog users from unfriendly, disrespectful or illegitimate Blog use. Please read them carefully.

By posting, you agree to the Blog Rules. Orange reserves the right at its sole discretion to remove material from Blogs at any time.

Restrictions

1. You must be over 18 to use Blogs.
2. You must not use Blogs to harass, threaten or attack anyone or otherwise behave in any way which would cause annoyance, nuisance, inconvenience or distress to other users. In particular, you must not use Blogs for the following purposes:
1. To transmit or knowingly receive content and/or language that is in any way unlawful, fraudulent, hateful, sexual, racially or ethnically or otherwise objectionable, defamatory, threatening, menacing, offensive, or obscene or in breach of any obligations of confidence. This includes the use of swear words and the use of offensive nicknames.
2. To flood or “spam” Blogs or any user who posts on the Blog.
3. To post links to web addresses, except in your user profile(s).
4. To provide instructions for illegal or otherwise harmful activities.
5. To transmit or knowingly receive information relating to (or include links to) pornography, pirated software and/or computer games or other counterfeit goods.
6. To collect and/or distribute personal data concerning other users of Blogs or Orange members.
7. To impersonate another person, whether a friend, family member, celebrity, Blog monitor, Orange employee or other Blog participant.
8. For the purpose of commercial gain. This includes the transmission of advertisements and any other attempts to generate business from other users of Blogs.
9. To post chain letters or pyramid schemes.
3. You should not act in any way to disrupt the flow of an ongoing discussion. If a user does not wish to participate in an ongoing discussion, or wishes to discuss a non-related topic, they are requested to go to the relevant blog. Orange may delete postings that appear irrelevant to the discussion in which they are posted.

Your Responsibilities

1. You may be held legally accountable for what you say or do online. In particular, you may be held liable for any defamatory comments, threats and untrue statements or other illegal or fraudulent claims made by you. In submitting material to Orange for use on Blogs you warrant that the material is fit for publication and agree to indemnify us in the event that it is not.
2. You may be held accountable for any breach of the rights of a third party if you have not obtained their prior consent to the use of their property.
3. You agree and warrant that you will comply with the terms of any agreement required by the owner or licensor of any intellectual property rights as may exist in all software and information you access or post via Blogs and to indemnify Orange against any action or cost suffered or incurred by Orange as a result of a breach by you of this term.

Disclaimer

1. Orange does not undertake to monitor every communication or the conduct of every user of the Blogs service. Blog editors may be online from time-to-time to ensure that other users are adhering to the Blog Rules. Any monitoring activity may be undertaken by Orange or its appointed agent, acting on its behalf.
2. Orange shall have the right to and will make its best endeavour to promptly remove content which is reported to it, and it agrees based on its sole judgement - is in breach of the Blog Rules, but cannot guarantee to do so.
3. Neither Orange nor its third party contractors will be liable for the content of any material accessed via the Internet or any adverse treatment of any information placed by you anywhere on the Internet or any loss or damage that you may suffer as a result.
4. Orange does not endorse any opinions expressed by other users of the Blog.
5. Orange reserves the right at its sole discretion to remove material from Blogs at any time.
6. Blogs consists of information posted by third parties. As a result, Orange accepts no liability in respect to the accuracy or truthfulness of any advice, information or data posted online or any responsibility for the consequences of your acting in reliance on such information.
7. This disclaimer does exclude liability for death or personal injury as a result of our negligence.
8. If you fail to observe either the Blog Rules or Orange's Conditions of Membership at any time, Orange reserves the right, at its sole discretion, to exclude you (either temporarily or permanently) from Blogs depending on the nature and severity of your breach.
9. Orange reserves the right, at its sole discretion, to deny access to Blogs for repeated or serious breaches of the Blog Rules or Orange's Acceptable Use policy.
10. Orange reserves the right to change the Blog Rules at any time; such variations becoming effective immediately upon posting details of any such changes online.  By continuing to use Blogs you will be deemed to accept such variation.
11. By accepting the Blog Rules you agree that Orange may release your information (both present and past) to the relevant authorities where Orange believes that you have breached the Blog Rules or have used Blogs to commit unlawful acts. We also reserve the right to disclose your personal information where required to do so by law and where we deem it appropriate in response to complaints of a substantial nature.
12. If you choose or are issued with a user identification code, password or any other piece of information as part of any registration or security procedures, you must treat such information as confidential and are fully responsible for all activities that occur under your password and account. You agree to immediately notify Orange of any unauthorised use or breach of security. We cannot be held liable for any loss or damage arising from your failure to comply with this term. We reserve the right to disable any user identification code or password.

Privacy Notice

1. All Users are responsible for the safety of their personal information. Orange recommends that Users do not disclose their name, address, email address, telephone number or other personal information online.

General

1. We may suspend or vary the whole or any part of Blogs for any reason, at any time at our sole discretion without liability to you.
2. If any part of these terms are found to be illegal or unenforceable, this will not affect the validity or enforceability of the remainder of these terms.
3. The English courts will have exclusive jurisdiction over any claim arising from or related to your use of Blogs although we retain the right to bring proceedings against you for breach of these terms in your country of residence or any other relevant country. These terms are governed by English Law.
